| Getting CDR of mobile number |
Before explaining the procedure of obtaining the CDR
of a mobile number, I would like to provide an explanation of why one might

Why to get CDR of a Mobile Number?
The purpose and intention to obtain CDR may vary from person
to person. Some persons may require CDR for legitimate purpose but others
may have illegitimate purpose. Some legitimate and illegitimate purposes
to get CDR are as under:-
Entering into the Privacy of other individuals
Some peoples may require CDR of other individuals to enter
into their privacy and later on to blackmail, harass and to get their illegal
demands fulfilled.
Lack of trust in spouses (husband/wife)
Spouses mean husband /wife. When one or both the spouses loose
trust on each other, they may get CDR of other spouse.
If a wife obtains CDR of her husband, she may want to know to
which girls/ladies her husband makes calls, how long their calls last, at what
time her husband makes call etc.
If a husband obtains CDR of his wife, he may want to know to
which boys/gents, she is in contact, to what mobile numbers her wife make calls
and how long they conversant etc.
Occurring of a crime
For example, a murder of any person has been committed
and legal heirs have suspicion on someone about his involvement in the murder.
The legal heirs of deceased may need to get CDR of that suspect person to know that on the time or date of murder
what was the location of suspected person, to what person did he call, and how
many persons called him on his mobile number before, during and even after the
murder of deceased.
If after obtaining CDR, the presence of suspect is found at
the place of occurrence on the date and time of murder, the suspicion of legal
heirs may transform into certainty and the legal heirs may nominate such person
in FIR.
Abscondence of accused
If an accused in an FIR is not joining investigation and
Investigation Officer is of the firm view that the accused is actually culprit,
the Investigation Officer may get CDR to track the location of accused and
other details which may help the Investigation Officer to arrest the accused.
In the same way if a person during trial does not appear before
the court on future dates of hearing, the court can declare such accused absconder.
So to track such absconder, CDR of such absconder may be helpful.
In the same way, there are many other crimes, after
which CDR of a mobile numbers is required to be obtained to connect any suspect
with commission of offence.
Anyhow, CDR is not the only proof that any suspect has committed
a murder, CDR is just a piece of evidence / supporting material. It is the duty
of court to record evidence and to pronounce the judgment on the basis of
evidence so produced before the court.
How to get CDR of Mobile Number in Pakistan
In
Pakistan, a private individual is not legally authorized to get the
Call Detail Records (CDR) of a mobile number belonging to another person,
regardless of whether the purpose behind obtaining the CDR is legitimate or
not.
Only Law
Enforcement Agencies, Investigation Agencies, and Intelligence Agencies may have
access or can get CDR
Please note
that an Investigation Officer is also not authorized to obtain the Call Detail
Records (CDR) of a mobile number belonging to another individual unless there
is a registered FIR (First Information Report) or complaint.
