thinking that the court marriage process involves solemnization of marriage in the
court and then issuance of certificate by court, which in fact is only a
misconception and nothing else.
Though we use
word “Court Marriage” but in reality, all the process of such marriage takes
places out of the court. The court does not take part into the marriage solemnization
process.
The court
marriage process is usually done in a Lawyer’s Chamber or any other premises
within the area of “Kechehry” but out of the court premises.
The Nikah
Khuwan/Nikah Registrar, who is already present in Kechehry, is called for
solemnization of Nikah. The Nikah is solemnized there in the presence of both
bride and bridegroom and a Nikah Nama is written down. This Nikah Nama is the
same as we see in our daily routine cases.
After
solemnization of Nikah Nama and writing down Nikah Nama, the Nikah Khuwan who usually
is also a Nikah Registrar cause this Nikah Nama to be registered in the
concerned Union Council/ Cantonment Board.
The
registration of such Nikah Nama may take few days. Once Nikah Nama is
registered in the relevant department, same Nikah Registrar provides the
registered Nikah Nama to the lawyer or the parties whatever the case may be.

There is no
difference between Nikah Nama written and registered in result of arrange
marriage and the Nikah Nama written and registered in result of court marriage.
Only the process is little bit different as I have already explained in
preceding paras. .
Court’s intervention in Court Marriage
A court does not directly interfere into the court marriage process.
However, on filing a complaint known as “Private Complaint” by bride against
her own family members (father, mother, brothers or other family members) in the court, the court
issue notices to the parties to appear and defend the allegation leveled in the
complaint.
In this type of private complaint, the bride makes allegation against her
family members that her family members are unhappy with her court marriage and they
have tried to attack on her and her husband with the request to the court to
take legal proceedings against the family members of bride and to grant them
safety.
So, it is advised not to level any false allegation against your
own family members who are actually not involved in any incident.
A court marriage is a sensitive matter and sometimes it causes loss even
to the lives of the bride and bridegroom as well. Lastly, it is recommended
to avoid court marriage and try for arrange marriage only to avoid any loss.
